These terms govern the use of DownFeeds (https://downfeeds.com) and form the agreement between Atomicini S.r.l., registered office [registered office], VAT no. [VAT number] (the "Provider") and whoever creates an account (the "Customer"). By creating an account the Customer accepts them.
1. The service
DownFeeds periodically checks the availability of websites, APIs, servers, DNS records, certificates and scheduled jobs indicated by the Customer; alerts the Customer about outages and recoveries through the channels it configures; keeps statistics and incidents; lets the Customer publish status pages and use an API.
2. Account
- The service is reserved for adults. The Customer provides true data and keeps it up to date.
- The Customer keeps its credentials and API keys safe and is responsible for activity under its account; any suspected misuse must be reported and the password changed.
- Automated or bulk account creation is not allowed.
3. Pricing and usage limits
- The service is currently free of charge.
- The Provider may introduce paid plans with at least 30 days' notice. No amount will ever be charged without the Customer's explicit acceptance.
- To ensure quality for everyone, the Provider sets usage limits (e.g. maximum number of monitors, minimum check interval), shown in the app, and may change them.
4. Acceptable use
The Customer only checks resources it owns or is authorised to monitor. Using the service to do the following is forbidden:
- overloading, attacking or disabling third-party systems, or unauthorised network and port scanning;
- circumventing security measures or access controls, or testing vulnerabilities without authorisation;
- publishing unlawful or offensive content, or content infringing third-party rights, on status pages or in notes;
- reselling or providing the service to third parties without the Provider's written consent.
In case of breach, or of use putting the service or third parties at risk, the Provider may reduce check frequency, suspend monitors or the account, notifying the Customer when possible.
5. Availability
- The Provider keeps the service running with due professional care but does not guarantee a minimum availability (SLA) unless agreed in writing.
- By their nature, checks can be wrong (false alarms or missed outages), e.g. because of intermediate network issues or the behaviour of the checked systems. Alert delivery also depends on third-party services (email, Telegram, push).
- The service may be suspended for maintenance, preferably with notice.
- DownFeeds is a support tool and does not replace the Customer's own controls and procedures for critical services.
6. Liability
To the extent permitted by law, the Provider is only liable for damage caused by wilful misconduct or gross negligence (Art. 1229 of the Italian Civil Code) and is not liable for indirect damage, loss of profit, data or opportunity arising from the use or unavailability of the service. Consumers keep all protections that cannot be limited by law (Italian Consumer Code, Legislative Decree 206/2005).
7. Data and privacy
- Account data is processed by the Provider as controller, as described in the Privacy policy.
- Where the Customer is a business and enters third-party personal data (e.g. colleagues' email addresses receiving alerts), the Provider processes it on the Customer's behalf as processor under Annex A, which is part of these terms.
- The Customer can download its data at any time from Settings.
8. Intellectual property
DownFeeds' software, brand, graphics and texts belong to the Provider. The Customer keeps ownership of the content it enters and grants the Provider only the right to use it to provide the service.
9. Term, withdrawal and suspension
- The agreement has no fixed term.
- The Customer may withdraw at any time, free of charge, by deleting the account from Settings.
- The Provider may withdraw with 30 days' notice by email, or immediately in case of serious breach of section 4.
- On termination, data is deleted as set out in the Privacy policy; the Customer may download it beforehand.
10. Changes to these terms
The Provider may change these terms for technical, organisational or legal reasons, announcing material changes by email or in the app at least 15 days before they take effect. A Customer who does not accept them may withdraw before that date; continuing to use the service afterwards means acceptance.
11. Notices
Notices to the Customer are sent to the account email or shown in the app. Notices to the Provider go to [contact email].
12. Governing law and jurisdiction
These terms are governed by Italian law. Disputes with consumers fall under the court of the consumer's residence; in all other cases the court of Torino has exclusive jurisdiction.
13. Specific approval
Under Articles 1341 and 1342 of the Italian Civil Code, the Customer specifically approves sections 3 (usage limits and changes), 4 (suspension for unacceptable use), 5 (no guaranteed service levels), 6 (limitation of liability), 9 (withdrawal and suspension), 10 (changes to the terms) and 12 (jurisdiction).
